    Outline of EPR Registration for Plastic Waste Management

    Extended Producer Responsibility applies to any organisation that introduces plastic packaging to the consumer market. The entity must handle plastic packaging till its end of life by applying EPR in an ecologically responsible way.The Ministry of Environment, Forestry and Climate Change (MoEF&CC) outlines in the Plastic Waste Amendment Rules 2022 how the Central Pollution Control Board (CPCB) awards EPR Authorizations to producers, importers, brands owners (PIBO), and plastic waste processors for recycling and other activities (waste to energy, waste to oil, and industrial composting).

    To encourage the reuse, recycling, and end-of-life disposal of recycled plastic, EPR Authorization must be complied with by all organisations that produce pre- and post-consumer plastic packaging waste. It is important to register with the CPCB and SPCB. PIBOs operating in more than two states or UTs must register with CPCB.  An EPR Registration for plastic waste management is required before manufacturing can start. According to the most recent requirements outlined in the Plastic Waste Management (PWM) (Amendment) Rules, 2022, a PIBO is required to submit Form I and an Action Plan considered suitable under the Environmental Protection Act, 1986, and to satisfy all prerequisites.

    Liability Imposed On

    The following organisations must register with the Central Pollution Control Board (CPCB) on the website in order to comply with India’s plastic waste management EPR provisions-

    1. Packaging producer P(Producer)
    2. Plastic packaging importer I(Importer)
    3. Other than micro and small businesses, BO (Brand Owners)
    4. Processors of plastic waste engaged in-
    • Recyclables
    • Energy from waste
    • Oil from waste
    • Composting in industry

    Registration procedure with the CPCB (Central Pollution Control Board)

    The following procedure can be used to get EPR  Certificate for Plastic Waste Management-

    • We will send the paperwork to the relevant SPCB/CPCB department.
    • We’ll give the requisite paperwork top consideration.
    • Working in conjunction with the relevant authorities
    • If the application and supporting papers are accepted by the officials, an authorization certificate will be issued. If there are any objections, we will take the required actions to receive the EPR authorization.

    Required Documents for EPR Certification Process

    1. Copies of PAN and Aadhar Card (For Authorized Persons) with sign and stamp

    4. Authorized Person Signature (Jpeg.)

    6. Select States / UTs in which the Importer is operating
    7. Total Capital Invested in the Project ( Rs in Crores )
    8. Packaging Material Photo
    9. Purchase and invoices for the last two financial years
    10. Total number of container imports in a year.

    Plastic packaging categories covered by the EPR

    The following categories of plastic packaging are subject to EPR:

    • Category I- Rigid plastic packaging
    • Category II- Flexible plastic packaging of single layer or multilayer (more than one layer with different types of plastic), plastic sheets or like and covers made of plastic sheet, carry bags, plastic sachet or pouches.
    • Category III- Multilayered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic).
    • Category IV- Plastic sheet or like used for packaging and carry bags made of compostable plastics.

    Banned Plastic Products in India

    Items that are prohibited include stirrers, plates, cups, glasses, cutlery, straws, trays, plastic wraps or packaging around candy boxes, earbuds with plastic sticks, balloon sticks, plastic flags, candy sticks, ice cream sticks, and polystyrene (Thermocol) decorations.

    Having effect from December 31, 2022, the Plastic Waste Management Amendment Rules 2021 forbid the production, importation, storage, distribution, sale, and use of plastic carry bags having a thickness of less than 75 microns and less than 100 and 20 microns.

    Cancellation and Renewal Procedures Of EPR Authorization for plastic waste management

    • Registration granted for PIBOs under the PWM Rules, 2016 (as amended), does not require renewal and shall be changed only on the request of Producers,  Importers & Brand owners, under the existing Extended Producer Responsibility registration.
    • If PIBOs provide fraudulent documentation to EPR, their registrations may be cancelled or terminated at any moment.
